Getting the Right Legal Advice

Why Lawyers Are Necessary During Child Custody Cases

Getting divorced is complicated when you have kids, and it gets worse when both parties can't agree. It's hard to get two adults to agree on simple issues when they keep insulting and threatening each other. While it's possible to win a child custody case without a lawyer, it's always good to have a family lawyer representing your interests and that of your child. Here is why a family lawyer is necessary:

i.    Stubborn partner or spouse

If your former spouse is hard-headed and won't agree to your terms without a fight, you might want a family lawyer. There are so many feelings involved between the two of you, and the thought that you could settle this amicably might go wrong. If your partner hates you, do you think he or she will prioritise the interests of the kids or make sure you're miserable? Having a family lawyer ensures that both parties are civil and the interests of the child are prioritised.

Some partners are stubborn, and it's hard to trust that they will hold up their end of the deal. For example, you could both agree to share the kids where one parent gets to stay with the kids on weekdays and the other on weekends. However, after a few months or weeks, your ex decides that he or she will keep the kids. In addition, they decide to convince the court that you're unfit to be a parent. You need a family lawyer to help you with such complications.

ii.    Experience

Although you want the best for your child, you aren't as good as an experienced family lawyer when it comes to winning child custody cases. There is a lot of paperwork involved, including visitation schedules, court dates, etc. You can manage all this, but having a family lawyer will improve your chances of winning the case. Unlike you, the lawyer understands this case and knows how to present your argument to the judge in a compelling manner.

iii.    The best interest for your child

At the end of it all, you want your child to be happy. The child might be happy being with your ex or you, but you need to convince the court that you're more than capable of handling the child's needs. Your family lawyer will help present your case to the judge in a convincing manner and justify why you should get custody.

If you can agree with your partner about co-parenting without a lawyer, then do it. If not, a family lawyer will come in handy.
